What is pre-legal collection?
Pre-legal collection is the first phase of debt recovery, where a local collection partner works to recover your debt without court involvement. This phase focuses on negotiation and communication with the debtor to secure payment through amicable means.
Pre-legal collection is governed by the Standard Debt Collection Agreement (SDCA) and operates on a "No Cure, No Pay" basis. You only pay a success fee if the debt is successfully recovered.
When does pre-legal collection begin?
After you submit a case, Debitura validates the claim details and documentation. Once validation passes, the case is assigned to a local collection partner who reviews and accepts the case. When the partner accepts, your case enters the "Active" status and pre-legal collection begins. For details on the full process, see Case lifecycle.
What collection methods are used?
The collection partner selects and executes all collection activities based on local regulations, best practices, and what is most effective for your specific case. Common methods include:
Letters: Initial demand letters, follow-up reminders, and formal notices
Phone calls: Direct contact with the debtor to clarify disputes and negotiate payment
Digital outreach: Emails, SMS, or messaging apps where lawful and appropriate
Negotiation: Payment plans or settlement discussions when the debtor engages
The exact mix, timing, and intensity of these activities varies by jurisdiction. The collection partner adapts their approach based on local laws, available contact data, and expected recovery likelihood. Debitura provides baseline effort guidelines, but the partner determines the final strategy for each case.
How long does pre-legal collection last?
The standard collection period is 6 months. During this time, the collection partner has exclusive rights to work on your case. You cannot engage other collection agencies or withdraw the case without paying the full success fee.
The collection period automatically extends by 12 months if the debtor provides a written promise to pay, signs a payment agreement, or makes any payment. These extensions protect the partner's investment in cases showing progress.
What is your role during this phase?
While the collection partner handles the direct recovery work, you have important responsibilities:
Respond promptly: Check the platform for updates and respond to any requests within 72 business hours
Report direct payments: If the debtor pays you directly, notify the partner in writing within 3 days
Report disputes: Inform the partner immediately if the debt becomes disputed
Provide information: Supply any additional documentation or details the partner requests
Do not contact the debtor: During the collection period, let the partner handle all debtor communication. If the debtor contacts you, forward the inquiry to the partner

What outcomes can you expect?
Pre-legal collection can result in several outcomes:
Full payment: The debtor pays the entire outstanding amount
Partial payment: The debtor pays some portion of the debt
Payment plan: The debtor agrees to pay in installments (up to 6 months without your approval; longer plans require your written consent)
Settlement: A reduced amount is accepted to close the case (requires your approval)
Pre-legal exhausted: The partner completes all reasonable collection attempts without payment
Debtor untraceable or insolvent: The debtor cannot be located or has filed for bankruptcy

What happens after pre-legal collection?
If pre-legal efforts do not result in full payment, you have options:
Legal escalation: If the partner offers legal services (or Debitura sources quotes from local attorneys), you can pursue court proceedings under a separate agreement. See Legal action for details.
Case closure: If further action is not economically justified, the partner may recommend closing the case.
Withdrawal: After the collection period ends, you may withdraw the case without fees.
Legal action is not covered by the standard agreement and requires your explicit approval before proceeding.
