Collection Partners: Legal setup when you submit cases via your Partner account (acting as a client)

When you submit cases to Debitura's network on behalf of your own clients, you assume the role of "Client" in the platform's workflow. This means the standard Standard Debt Collection Agreement (SDCA) pricing and terms apply to you

What it is

As a Collection Partner, you can use Debitura in two distinct capacities:

  • As a Collector: When you receive cases from other Debitura clients for local collection in your jurisdiction.

  • As a Client: When you submit cases on behalf of your own clients (creditors) for collection elsewhere in Debitura's network.

This article explains the second scenario: when you act as the "Client" by uploading cases for your own end-clients. In this role, you assume all responsibilities of a Client as defined in the SDCA.

Why it matters

Understanding your legal obligations when submitting outbound cases is essential because:

  • You become contractually bound by the same terms that apply to regular Debitura clients.

  • Standard success fee pricing applies to cases you submit.

  • You must have proper authorization from your end-client before placing their case on the platform.

  • The receiving Collector has exclusive rights to the case during the collection period.

Authorization from your end-client

Before submitting a case on behalf of your own client, you must obtain proper authorization (such as a power of attorney) from that client. This authorization allows you to:

  • Place their case on the Debitura platform

  • Act on their behalf during the collection process

  • Receive communications and updates about the case

  • Authorize the assigned Collector to pursue recovery

The exact form of authorization depends on your jurisdiction and agreement with your end-client. Common approaches include a signed power of attorney, a clause in your existing service agreement, or explicit written consent.

SDCA signing requirement

Both Exclusive and Legal Network partners must sign the SDCA before creating or submitting new cases to the platform. The SDCA covers:

  • No cure, no pay pricing model

  • Success fee rates based on claim size, region, and age

  • Six-month exclusive collection period

  • Payment handling and disbursement

  • Your obligations as the Client in the workflow

What to expect

Once you submit a case as a Client:

  • Debitura matches the case with a local Collector based on the debtor's jurisdiction.

  • The assigned Collector has exclusive rights to collect the claim for six months.

  • Standard SDCA pricing applies to the case.

  • You receive updates through the Debitura platform.

  • Upon successful recovery, the Collector deducts their success fee and remits the balance.
